Distanasia and Substitute Consent

This book analyzes the elements or circumstances that allow the unexpressed will of a patient with a serious and incurable illness to be taken by another person to avoid dysthanasia. Likewise, it reflects on the situations that expose children and adolescents (NNA) to a greater risk of being subjected to dysthanasia. For this, a qualitative methodology is used, with an interpretative hermeneutic design and critical discourse analysis through documentary reconstruction. It is concluded that human dignity is not reduced to autonomy but also encompasses the right not to be subjected to humiliations or abuses that, contrary to compassion, exacerbate existential, social, and moral vulnerability, resulting from the imposition and domination of a moral valuation system that considers life merely as subsistence. This work is justified because it addresses current issues regarding end-of-life decisions in adults and NNA with serious and incurable illnesses. This is approached from interdisciplinarity and transdisciplinary, which allow the analytical and critical convergence of empirical approaches, theoretical and conceptual reflections provided by various areas of knowledge such as Law, Medicine, Bioethics, Philosophy, Sociology, and Anthropology on dignified death. Thus, it becomes a heuristic tool that serves as a source of consultation and contributes to ethical decision-making in interactive, transactional, and structural domains by patients, patients' families, medical professionals, healthcare service providers, interdisciplinary scientific committees, Ministry of Health and Social Protection, Health Superintendent, State social enterprises, judges who must resolve protective actions, and the Congress of the Republic.
